1. About these Terms

TapStory ("TapStory", "we", "us") is operated by TapStory inc.. These Terms of Service ("Terms") govern your access to and use of the website at https://tapstory.ai, the TapStory web application, and every story, image, audio file, share link or other feature we provide (together, the "Service").

By creating an account or using the Service you agree to these Terms, including our Acceptable Use Policy and Refund Policy, and you acknowledge our Privacy Policy and Children's Privacy Notice, which explain how we handle personal information. If you do not agree, please do not use the Service.

2. Who may use TapStory

You must be at least 18 years old, or the age of majority where you live, to create an account and to purchase a subscription. Accounts are for parents, guardians and other adults.

Children may use TapStory stories and the children's interface only under the supervision and with the permission of the adult account holder. The adult account holder is responsible for everything that happens under their account, including what a child in their care creates, listens to or shares.

You may not use the Service if you have previously been suspended or removed from it.

3. Your account

You sign in with a Google or Apple account. Your TapStory account is created automatically on first sign-in. Keep your sign-in provider account secure; you are responsible for activity that occurs through your TapStory account.

You must give us accurate information and keep it up to date. One person may hold one account. You may not sell, transfer or lend your account to anyone else.

4. The Service

TapStory is an independent product that uses third-party AI models to generate text, illustrations and narration. These models are integrations within our service; TapStory is not affiliated with or endorsed by their creators.

TapStory turns story ideas into illustrated, narrated picture books using artificial-intelligence ("AI") models. Depending on your plan you can create personalised stories starring the characters you define, browse and play stories from the TapStory collection, and share your stories with family through private links.

We continually improve TapStory and may add, change or remove features. Where a change materially reduces what a paid plan includes, we will tell you in advance and you may cancel before it takes effect.

5. Your inputs and your rights

"Inputs" are the things you give us to make a story: ideas, names, character descriptions, voice input, images and any other material you or a child in your care provide. You keep all rights you hold in your Inputs.

You grant TapStory inc. a worldwide, non-exclusive, royalty-free licence to store, copy, process and transmit your Inputs, including sending them to the AI model providers we use, solely to operate, secure and improve the Service and to provide it to you and the people you share with. This licence ends when you delete the content or your account, except for copies we must keep by law or that remain in routine backups for a limited time.

You are responsible for your Inputs. You confirm that you have the right to use them and, where an Input shows a real person's face or voice (including a child's) so that a story character can look or sound like them, that you are that person's parent or legal guardian or have their consent.

6. AI-generated content

Stories, illustrations and narration are generated by AI models ("Outputs"). AI can make mistakes: Outputs may be inaccurate, incomplete, unexpected or resemble content generated for other users. We apply safety guidance and automated moderation designed for young children, but no filter is perfect. Please review a story before sharing it with a child, and report anything unsuitable to support@tapstory.ai.

As between you and TapStory inc., and to the extent permitted by law, we assign to you our rights in the Outputs generated for your account, for your personal, non-commercial use. Because AI Outputs are not unique, the same or similar Outputs may be generated for other users and we cannot grant you exclusive rights in them.

You may not use Outputs to mislead people about their origin, to impersonate anyone, or in any way that breaches section 8.

7. Sharing and the public collection

When you create a share link, anyone who has that link can open and play the story without signing in. Share links only with people you trust. You can revoke a link at any time from your bookshelf; the previous link then stops working.

The stories in the public TapStory collection are selected and published by us. A story you create is never added to the public collection without your explicit agreement.

8. Acceptable use

TapStory is made for young children and their families. You agree not to use the Service to create, upload or share content that:

• is NSFW, pornographic, sexually explicit or sexually suggestive, sexualises minors in any way, or is violent, frightening or otherwise unsuitable for children;
• is hateful, harassing, discriminatory or promotes self-harm or dangerous activities;
• infringes copyright, trade marks, privacy, publicity or other rights of any person;
• depicts a real person, or uses a real person's face or voice, without the consent described in section 5, or to deceive, defame or harass anyone;
• is unlawful where you live or where we operate.

Our Acceptable Use Policy at https://tapstory.ai/legal/acceptable-use gives further rules for inputs, generation and sharing. You also agree not to attempt to bypass our safety filters, reverse-engineer or scrape the Service, interfere with its operation, or access accounts or data that are not yours.

We may remove content, and suspend or terminate accounts, that we reasonably believe breach these Terms. Where the law allows, we will tell you why.

9. Plans, credits and payment

Some features require a paid monthly plan. Plans include a monthly allowance of credits used to create personalised stories; unused credits expire at the end of each billing period unless we say otherwise on the pricing page. Where we offer one-off credit packs, purchased credits do not expire while your account is open.

Subscriptions renew automatically each month until you cancel. You can cancel at any time from your membership portal; your plan then remains active until the end of the current billing period. Details of refunds are in our Refund Policy.

Payments are processed by our payment partner, Creem, which acts as the merchant of record and handles your payment details and applicable taxes. We do not receive your full card number.

We may change prices. We will give you at least 30 days' notice before a price change applies to your plan, and you may cancel before it takes effect.

10. Termination

You may stop using TapStory at any time. You can delete your account and content by following the steps in our Privacy Policy.

We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if we discontinue the Service. If we discontinue a paid Service, we will refund any prepaid fees for the unused part of your billing period.

Sections 5 (licence for retained copies), 6, 11, 12 and 13 survive termination.

11. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement, and we do not warrant that the Service or any Output will be accurate, uninterrupted or error-free.

TapStory is an entertainment and creativity tool. It is not an educational, medical or child-development service and does not replace adult supervision.

12. Limitation of liability

To the fullest extent permitted by law, TapStory inc. and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or relating to the Service.

Our total liability to you for all claims relating to the Service in any 12-month period will not exceed the amount you paid us for the Service in that period, or 50 US dollars if you paid nothing.

Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, fraud, or the statutory rights you have as a consumer.

13. Governing law and disputes

These Terms are governed by the laws of Hong Kong, without regard to conflict-of-law rules. If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live, and you may bring proceedings in that country.

14. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will notify you by e-mail or by a notice in the Service at least 14 days before it takes effect. Continued use after that date means you accept the updated Terms. The current version is always available at https://tapstory.ai/legal/terms.
